Financial ombudsman decision not upheld for packaged bank account

Good morning all,
Was looking for some advise on replying to the FOD decision, I have until 14th July to do so.
Two years after graduating I was told that I was no longer applicable for the student account and had to move to another account. At this time I was still using my free OD on a regular basis and was sold the Barclays Graduate Editions for a fee of £5 per month. I was not given any other options. This also came with Mobile phone insurance, car breakdown etc. I received a letter and I called the bank to discuss my options.
The adjudicator who originally reviewed the case recommend that the case should be upheld and agreed with the points that I had made.
The ombudsman has reviewed the case and the provisional decision is not to uphold the decision.
During the term I had claimed on the mobile phone insurance but not used any of the other benefits.
The summary from the FOM is :- "I don't see enough evidence to conclude that Barclays failed to give a fair choice, as she was no longer going to benefit from having a preferential overdraft she opted to take the graduate additions account. This is because it offered her some benefits that she thought would be useful. So I don't think she'd have decided against upgrading even if Barclays had given her better recommendation".

My advice is to drop your claim. You claimed on the mobile phone insurance, so you've benefited from the account. If it was an expensive phone, you might have received more than you've paid in bank charges anyway.
If you managed to get the £5 per month charges refunded, you should in fairness have to repay the money you received for your insurance claim.0 -
Did the graduate account come with favourable rates for the overdraft?
If so you have been given good advice from the ombudsman - forget it as you will get nowhere.0
