How long before i can claim ESA again?

The assessment did the usual thing and scored me zero points, as i was expecting, so how long must i wait now until i can claim ESA again? Now claiming JSA and i want to go back on ESA or just sick with sick note from doctor would be ok for now.

Any ideas anyone?

    You can't claim again for the same condition unless it's got worse.
    Unless I say otherwise 'you' means the general you not you specifically.

    Its not the same condition as i claimed for before. Totally different.

    It is on mandatory reconsideration now, i expect they will not overturn it despite any evidence i give so i believe it will go to tribunal, there i may be able to give a voice recording of the assessment and prove that the report is actually nothing like the assessment was, either the JC decision maker or the "health professional" has fabricated the report.

    During mandatory reconsideration you will have to continue to claim JSA. if you are unfit for work you can get a fit note from your doctor and 'go sick' whilst on JSA.

    If they do not overturn the decision at MR then you can go to appeal. Once your appeal has been accepted then you need to ask to go back on ESA assessment during the appeal process. It is not automatic.

    I would suggest getting some advice from your local CAB.

    If you are awaiting an MR decision from the DWP, it may not be a good idea to re-apply for ESa on a new condition until you have completed the appeal process on your original claim.

    Once the your appeal is lodged with the Tribunal Service, you can ask for ESa payments to be reinstated.
