Creeping/flying freehold

We are buying our first home, a mid-terraced freehold house with a garage in a nearby block.
The garage is included in our freehold title; great.

The problem is that there is a leasehold flat situate above the freehold garage (which is the same for all the garages in the block). From looking at various title registers, it seems that the freehold owner of the flats (the council) once also owned all the garages but these were siphoned off to the various house owners. Our neighbours all have their garages included in their freehold title.

Our seller has provided us with an indemnity policy (flying freehold.covering the defect within the title regarding the lack of adequate provisions for rights of support, protection etc. All fine and dandy.

My issue is - what happens if there is a fire in the flat above, which would in turn burn down our garage? it seems Contingent Buildings Cover isn't applicable because our garage is freehold.

any bright ideas?!
