Defects found during 1st time usage

Looking to see where I stand with returning goods to go outdoors. I had a tent exchanged 11 months ago due to the poles breaking on during its first trip. I've only just opened the newly exchanged tent to find it looks like it has been used in the passed. There where 2 bents poles, holes in the ground sheet and tent it's self, both the tent and bedroom are covered in mold ando the tent leaks when it rains. Any advice would be welcome. Thanks in advance.

    When was the original tent purchased? Was this newer one a straight out replacement or did you have to make another purchase?

    Is the tent advertised as waterproof or water resistant? I believe some waterproof tents sometimes require getting wet first before being used (holes in fabric due to stitches which then disappears as the material swells with water).

    After 11 months, the onus is now on you to prove that the tent was supplied to you in the condition that you state, something that will be next to impossible to do.
    Of course, this is assuming that the retailer in question actually asks you for this proof, something that they may not do.

    All you can do is to contact them and explain what has happened and take it from there.

    The original was purchased about 1 month before the exchange. We where offered an exchange for the same tent or another one of equivalent price

    The holes in the fabric look like from the previous owner as the nearly line up with where the tent pegs should go if the foot print wasn't there. As for waterproof or water resistant the first one didn't leak

    As shaun says above, contact them and see what they say. They may be able to check back their records and see the one they sent you had previously been returned by someone else.
