Voluntary redundancy law advice

I am looking for some legal advice as I think my manager hasn't followed the correct procedures during the redundancy process.

We had a letter last week to advise there were to be redundancies and that our department had a meeting scheduled yesterday. In this meeting we were asked to consider voluntary redundancy and that they were looking to make 2 people redundant. The deadline to put ourselves forward was today at 5pm. My colleague volunteered yesterday afternoon and my manager accepted and immediately began the process for him. He received his paperwork this morning. I also wanted to volunteer and spoke to my manager yesterday afternoon where she refused as she had already accepted my colleagues.

Am I correct in thinking that she should have waited until after the deadline to give everyone the opportunity to apply?? I can't believe it is a first come first served process? Also she said 2 people were at risk but she obviously meant one girl who is currently on maternity leave and one of the remaining staff. I feel this is all wrong and am just looking for confirmation before I confront her!

Any advice would be appreciated

    Voluntary redundancy doesn't technically exist, your friend has had a settlement agreement to leave work. As such the employer does not have to accept someone's request to have a settlement agreement....so yes a first come first served basis is ok to do.

    There can be many reasons for refusing this even if they have not met their initial requirements.

    As for the maternity leave lady, she may have requested the settlement agreement but just bear in mind she has far greater protection than you if redundacies become compulsory.
    Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked
