Breach of Condition Notice on a house purchase?

    The only thing that concerns me is maybe they do know what it is, and that's why they are being so difficult?

    The estate agents just told me "they (the repo company) have told me again today that they won’t be acting on this breach of condition notice and to them it is down to you and your solicitor to sort if you wish or to go ahead with this."

    no point worrying until you know what it is that you're up against. as i said it may be a relatively simple issue to sort out at little expense. post up what it is when you've had your meeting with the Council.

    It could be something simple to rectify or it could be a serious breach - I know of a repo case where the breach of conditions was serious (build did not comply with approved plans) and there was a demolition order against the property. Luckily the potential buyer was diligent in doing their research and was able to walk away having lost only their legal fees to that point.

    In my experience, the Repo company's reluctance to get involved is completely normal. Repos are generally sold as seen they accept no liability or responsibility for provision of the sort of information and detail that would be standard in normal conveyancing.

    You have to know what you're dealing with...only a fool would proceed without being in full possession of the facts.

    So after the visit to the council I was able to obtain a copy of the notice for £35, which had confirmation it had been complied with.

    It dates back to 1994, and was in relation to the previous building on the plot of land. Council confirmed that there is no ongoing liability! :T
