Barclaycard rejected EGG PPI Complaint

Morning,
I've received a rejection letter from Barclaycard saying they won't uphold my complaint regarding Egg PPI complaint. Although the box was pre ticked for ppi, they say I should have un ticked it.
I'm pretty sure that that at the time (2000) it didn't allow you un tick it to proceed with the application.
Can anyone advise on this?

From what you say, this was an internet application (as you cannot untick a paper application).

That will not be correct. If it was, then every egg cardholder would have PPI and that is not the case.I am an Independent Financial Adviser (IFA). I got an EGG card as soon as they came out and no PPI ever.0

Refer your complaint to the Ombudsman Service, they will investigate whether you could have unticked the box at the time of your application. Generally speaking, though, even an option to untick the box would still be regarded as mis-sold.0

A key issue for FOS will be whether you had to actively opt out of the PPI.
If you had to either tick a box saying you didn't want it, or untick a box saying you did then it is likely to find in your favour.
However, proving that you did not simply tick it "on autopilot" may prove difficult.
It is probably worth trying, though.0 -
I'm not sure there were any issues with Egg's online application process for the duration they were selling PPI - you always had to tick a box to say you wanted to add the policy to your credit card. And in some instances possibly also had to tick a second box to confirm your selection.
If you can quote what Barclays have said verbatim then that might help. But otherwise, there's nothing to stop you from referring your complaint to the ombudsman who might find it upholds for another reason other than consent.
And even if they don't find the complaint in your favour, because it looks as though Barclays has taken responsibility for your complaint rather than Canada Square then it's almost certainly affected by the Plevin judgement (as all Egg cards still active in 2011 (?) were transferred to Barclays)0 -
I've been reading some threads on here regarding EGG today as I've yet to take it to the FOS.
I wrote to Barclaycard and not Canada Square. I've noticed some threads on here saying that Canada Square are still dealing with EGG PPI complaints. Does anyone know if this is correct? Should I go straight to the FOS or send to Canada Square instead?
I did reply to Barclaycard as they rejected my complaint on the grounds that the PPI policy would have benefited me at the time, rather than the fact that I didn't request it and it was pre ticked. They replied saying unless I had further info to open the case they won't be looking into it anymore.0 -
If you've written a complaint to Barclays and they rejected your complaint, you can't simply write to another address with the same complaint!
Your complaint has already been rejected by the firm who took over responsibility for the sale of your insurance. If you continue to remain dissatisfied, your only realistic option is to refer the complaint to the Ombudsman. I told you this almost three weeks ago at post #4 of this thread.0
