My PC Backup Cloud Backup

Hey, My first thread. Here goes:
I've been backing up my data to My PC Backup, a paid cloud back up service, for 2 years. My hard drive recently crashed and I have tried to retrieve my data from the service but it seems the data isn't there.
When contacting them they took a week to email me back but only after a second email and they say that they have issues due to server migration and that they are rolling out the scripting in batches. I should check back every four days and let them know when the data is back. I've now been without my files for over a week.
I've searched on line and found other stories of this happening going back to last year with other customers saying they've never retrieved their data. This is very worrying and I guess I'm wondering:
1 Has anyone else had this experience?
2. What happened if you have?
3. What can I do to report this if it looks like it's a dodgy company?

Take control of your own data in future, for as you've found out to your cost, you can't trust others.
Depending on the severity of the data loss, you may want to haul them through small claims court, or sue them for millions.

It's important stuff to me. I guess not in the great scheme of things. My accounts and general work files. I have access to most of these via shared files in dropbox but not my finances or accounts unfortunately and it's these I really need access to. I feel pretty stupid now. I thought by backing up to the cloud this was what I was doing as when I tried to buy an external hard drive from currys I was told that the cloud is what people do now. Never take advice without doing the full research I guess...0
