Faulty Engagement Ring

Last June my future son in law proposed to my daughter and purchased an engagement ring from the Diamond Store. It is a square solitaire surround by a square band of small diamonds and diamonds are also set in the band that goes around the finger. When it arrived my daughter was delighted with it, but it was too big. she returned it to them as they offer to do free alterations as part of their service. When it came back she wore it for a couple of weeks and a diamond in the finger band dropped out. She returned it to have it repaired. Shortly after this another diamond dropped out, this time in the band surrounding the solitaire. She contacted them again and they said she was not the type of person this ring is suitable for! She is a 28 year old office worker that really takes care of her jewellery, taking it off at night, when she washes her hands or does any housework. They begrudgingly repaired it again. Once again she has worn it and a diamond has fallen out, they have now told her they are willing to repair it one last time or she can have another ring but not that design as it is unsuitable for her! she is devastated, she doesn't want a plain solitaire. It isn't a piece of dress jewellery but her engagement ring which should be very special. She now wants a full refund but they have refused. I am thinking of offering to pay for her to make claim through the small claims court, but don't want to end up paying a large amount of money if we were to lose. Does it sound like I have a good case? sorry for the length of post!

    As it was purchased 12 months ago, by law she would be required to get a report to say that the ring is inherently faulty.

    It appears like she doesn't have that report but the retailer is still repairing the ring. They are offering to repair the ring one last time and then nothing after that - which is fine - considering you don't have a report.

    If you had a report to say the ring was inherently faulty then they can't refuse to either repair/replace/(proportionate) refund.

    As your future son in law bought the ring, in law he is the person who has to pursue this.

    Did she have to have it made much smaller? Sometimes having a ring made smaller can make the setting loose. A jeweller refused to make a ring I had smaller because of this.

    Did she have to have it made much smaller? Sometimes having a ring made smaller can make the setting loose. A jeweller refused to make a ring I had smaller because of this.

    Yes, some settings do not work well with altering the size. Chanel settings are the main one as it loosens the stones.
