Consumer Reclaim

Options
Hi

Can someone please advise me, I have received a payout from the above company for mis-sold credit. It was finance to have my roof sprayed, the finance provided by GE Money, I received a letter from GE Money and Consumer Reclaim on Thursday 16th June, GE Money were offering to pay me the total finance borrowed along with interest and writing off the balance. The letter from Consumer Reclaim stated that I was not to accept there offer but to send the letter back to them signed as they were still trying to get compensation. I tried to call CR to speak with someone re both letters but never heard anything until Monday 20th, they said again to sign the letter and send back to them as they were still trying to get compensation for the mis-selling. On wednesday morning when I check my back account GE money had paid the sum in my account, I called CR straight away as I was not expecting it, they said that GE Money were not given out compensation. They also then said that I would receive an invoice for £1600.00 for services used, I was totally gobsmacked. Never once was I told this was No Win, No Fee as I never went through them, I went through a company called UK Roofing Advisory. The amount I received was £3357.00 with a write off, off £1208.00 from my balance. They are now wanting this money which includes 20% plus vat of the total amount I received, but I did not receive £4565.00 into my account. Can someone please advise if they are allowed to take this amount.

If you signed up to it, yes.

Your post is very confusing - you need to work out what you signed with who.

It sounds as though you had also defaulted on the loan, which would explain the return being netted off against the balance. Did you explain this to the claims company?

Are you saying you have never agreed to using a third party to reclaim for you? If so, how did CR get your details?

    What paperwork have you signed?

That is strange as financial redress does not include compensation. The interest is effectively the compensation. You should get the capital refund plus interest. No more. no less.

How did you think this company was going to be paid for the work they have done?
What does your contract with them say?

You should never use a claims company if you have debts in arrears, defaults or amounts previously written off. They will bill against the full amount of the redress, even if you only get a smaller amount "cash in hand" as they have used the money against unpaid debt. A bit late now in your case, but yes, it is correct.

Plus, the service they offer is Vatable. So, again, that is correct.

Has anybody noticed the similarity between people who signed up to a CMC to get "their" money back from a bank and are now regretting it and those people who voted Leave to get "their" money back from the EU and are now regretting it?
