Debit Finance Collections Plc

Can I complain to the financial ombudsman about this company? Their status on the FCS register is in fact "Cancelled", so I'm not sure.


I need to complain to someone.


In Short here's what's going on:
They have failed to make payment requests on a direct debit they instructed on my current account on 31 March 2016.


The company was provided with an updated direct debit mandate direct from my bank on on 30 March - as a result of me doing a current account switch. Whilst they created the direct debit on my account on 31 March they have not made any payment requests on this direct debit. They have repeatedly failed to take payments or responed to my emails and letters.


They are now threatening me with debt collectors for the sum of £725 - for 2 payments of £20 that they could have, but didn't, fulfil via said direct debit that they have set up.
I have a much more detailed complaint ready to send off which includes copies of all emails and letters sent and received, as well as confirmation from my bank that the direct debit has been set up but that they've never requested payment.


I was going to send all this off to the financial ombudsman when the post office opens tomorrow morning, but then had a thought that they might not deal with complaints like this.


If that's the case, is there any other similar body that could assist me?

  • According to companies house the nature of their business is
    64929 - Other credit granting not elsewhere classified

    This leads me to think that they would fall under the financial ombudsman.

    The are supposed to be collecting £20 on the first of each month for a gym membership.

    If you phone the ombudsman, they'll be able to tell you if its within their remit or not

    Its going to depend on exact specific details and who you're complaining about and whether they're a regulated (by FCA) business. If there is a credit agreement for your gym contract then you should undoubtedly be able to refer it to them.

    Can't you just contact the gym and ask them to sort it???
  • Any time I've called in to the gym to tell them what's going on they don't listen and deny all knowledge and say everything to do with money/memberships has to go through this DFC company and just hand me their number scribbled on a piece of paper.


    I've written a 3 page complain to the financial ombudsman anyway, with 9 supporting documents which I intend to send next day deliver tomorrow morning.


    If the financial ombudsman won't deal with it, it's all written up and I will just find another ombudsman to investigate for me.

    Was a credit agreement involved? Was this debt collector/finance company a party to your contract (as a "management" company of the gym perhaps)?

    If not, stop talking to them and put your complaint in writing to the gym.
