Help please - Iphone stopped working 18mth after purchase

Hi
I purchased an iPhone 6plus from an online store in Jan 16.
The item has a scratch on the screen and I ended up having a conversation with the store owner, establishing a rapport, which helped later.
He explained that the phone would not have a warranty from him.

In April 16 I started to notice a deterioration in the battery life and by May it would no longer charge up. So I took the phone to an Apple store, where the employee was excellent. He told me there was a fault with the main board but as it was outside the 1 year guarantee, it couldn't be replaced.

However, he told me, and noted it on a Genius Bar Works Authorisation, that I could get my "Friend" to potentially look into a Consumer Rights option, as he was listed as the phone owner. I contacted the store owner and he happily sent me his original invoice, but he is unable to go to an apple store as he is disabled, although happy for me to go "on his behalf".

Has anyone had the experience of dealing with Apple Stores regarding this.
Any help or direction much appreciated.

Thanks
Monty

I believe it is possible to return Apple items for repair by post, so the person who sold you the phone should be able to do this.

However, there may not be much point. After 6 months from the original purchase of the phone, Apple are not obliged to repair, refund or replace unless the store owner can prove the fault was inherent at the date of purchase. This usually requires an independent report, which would have to be paid for. It might be worth googling the fault to see how widespread it is, and whether Apple has accepted it as an inherent fault in other cases.

Even if Apple accepted the fault was inherent, they are entitled to deduct an amount from the refund to take into account the time the purchaser has had use of it. If this has been almost 2 years (since the 6 plus was released), this may well be most of the cost of the phone.

Where did the original owner purchase the phone from? Directly from Apple or from another seller?

As the OP's title stated that the phone stopped working 18 months from purchase, this must mean that either they made a mistake in their opening post when they stated that they purchased it in Jan 16 or that when they purchased it, it was second hand hence the reason for the Apple warranty having expired.

Have to hand it to the seller - sells a phone they purchased and tells OP theres no warranty from him but forgets to mention about consumer rights.

Original purchaser is quite happy to be part of and encourage OP to possibly commit fraud all so he doesn't have to adhere to his legal obligations :rotfl::rotfl::rotfl:

  • Hi
Thanks very much for the replies so far.
I realise that my information was not entirely complete.

The iPhone was originally purchased directly from Apple in October 2014
I bought it from the online shop (it was advertised as Ex-Demo) in January 2016.
    Stopped working May 2016.

    Hi LilElvis
Sorry I had forgot to mention.
The iPhone was purchased in Oct 2014 directly from Apple and sold as Ex-Demo to me in Jan 16.
    Thanks

Then your rights are against the seller. As its failed within 6 months from purchase, the fault is assumed to be inherent and its for the seller to prove otherwise.

They can then offer a repair, replacement or even a refund (but as its under 6 months, they can't reduce the refund to account for use you have had).
