OP what packaging are you referring to?
Is this like brown box packaging thats generic/used to protect the item during delivery? Or is it official branded packaging for the item? Was it possible to ascertain they had sent the wrong goods without opening whatever packaging you're talking about? Would the fact it wasn't the item you ordered be obvious upon inspection?
In short, if the goods don't conform then they're liable. No I don't believe they could make a deduction for the packaging as CRA doesn't allow a reduction in price within the first 6 months on most goods (cars I think are the exception).
However you have a duty of care to take reasonable care of the goods and make them available for collection.You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
