The first sign you see is the one that says Parking from £1.

X will construct an appeal letter over the weekend. Thank you for all the help. I really appreciate it

This is an appeal letter. If anyone could cast an eye over it for any errors or omissions X would be enormously grateful... (X can't copy and paste here, for some reason, so here's a link to the doc on google drive)

Again, thanks for all the help so far :)

From a quick glance-over it looks OK to me. You've obviously used the newbies sticky initial appeal and adapted it. Just double check that none of your adaptations has revealed the driver's identity. Nothing jumped out at me as you having done this, but one final check from you before submission.

Follow the PPC's precise instructions for submitting the appeal. If they offer online or email definitely use that method. If it's postal only, then first class mail with free certificate of posting from your PO counter.

Don't forget to put your name, an address for service and your PCN number in the appeal.

Don't be surprised or disappointed if you receive a (inevitable) rejection at this stage. What you are really angling for is a POPLA code where you can get this permanently kicked into the long grass.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thanks for all this advice. X will check it again and hopefully submit it online. The one time I did this before there was a character limit on the appeal, so if that's the case X will have to post it. Fingers crossed but X is not expecting much obviously :wall:

I would NOT post any appeal snail mail except as a last resort (e.g. if a firm only allows postal appeal). I would simply cut out some waffle to make it fit, and double check that any drop-down identifier hasn't reverted back to 'driver' instead of 'registered keeper' (take a bow, UKPC, for that being the case on their webpage).

At POPLA stage this is winnable on 'no keeper liability' so be ready to ignore a letter which might arrive, begging you to name the driver...!

X emailed last night. They obviously read everything very carefully and thoughtfully (:rotfl:) and then sent this email to the registered keeper ...

"We write to acknowledge receipt of your recent online appeal regarding the issuing of the above Parking Charge Notice (PCN).

We note your comments and must refer you to the Protection of Freedoms Act (PoFA) 2012, Schedule 4 - Recovery of unpaid Parking Charges. This is available to view online at:
    http://www.legislation.gov.uk/ukpga/2012/9/schedule/4

We must therefore request that the details of the driver of the vehicle at the time of the contravention are supplied; this must include their full name and serviceable UK postal address. If you are unwilling or unable to provide these details the registered keeper of this vehicle will remain liable for this PCN. This information should be provided by 26th July 2016.

If we do not receive this information by the date given, the registered keeper of the vehicle at the date of event will be held liable."

Does X email back and refer them to the part of the original appeal that says they won't disclose who the driver was?

Good. Just reply 'bring it on' or ignore it and wait for the POPLA code! I would ignore it. They always send that desperate request for the driver to be dropped in it.

What I have just noticed and would recommend is that you EDIT your posts now, to remove anything about who was driving, in case the PPC is reading the forum. DO THAT NOW.

X thanks you for all the advice. If by any chance you have a moment to remove any quotes, x would really appreciate that!

Your dedication to helping others is absolutely extraordinary. I've tried to pass on some of the words of wisdom from knowledgable people here to local forums on Facebook, but people prefer to listen to the folks who say 'chuck it in the bin' etc.

Many thanks for your time, as always.

  • I WON at POPLA stage!!! Yay! Many thanks for all the advice.

I have a PDF document on google drive which is my appeal to POPLA - please pm me if you would like to see it - I'd rather not post the link publicly. I found a thread on another forum about the same car park, which was invaluable.

Good luck to anyone else contesting an unfair charge. You CAN win!

Many thanks again to the people here who give so much time to help others
