Refund on an accessory to a faulty item?

Hi all,

Looking for a bit of advice as I'm not clear where I stand on this one. Basically I bought a tent that is faulty. It's a known manufacturing fault, so the retailer seems perfectly willing in his email to offer a refund or an alternative product.

Unfortunately, due to the known manufacturing fault a replacement is not an option. There are no stock being shipped, nowhere has any in stock (other than potentially faulty ones) and even the manufacturer themselves have the product marked as unavailable on the website and nobody can give any sort of ETA as to when the product will begin shipping again.

Long story short, I also bought an accessory for the tent which is a liner to protect the tent roof from UV damage, and the liner is specific to this particular model. There is nothing inherently wrong with the liner, but without the tent to which it fits it is basically just a £60 redundant piece of polyester.

Am I entitled to a refund on the accessory?

Retailer has only offered refund on the tent package itself so far (of which the liner wasn't a part but was bought at the same time) and I'd like to consider the best way of approaching the subject whilst armed with any useful information should he not be willing to refund.

Many thanks in advance.

Can you still use the liner on another tent or are you content with not buying another one after the refund?

According to the original guy it is specific to that tent

It is specific to the model, and hooks on to loops around the top edge of the tent. If whatever alternative tent we choose to buy has an available liner, I would prefer to buy the correct one that colour matches the tent and fits properly.

You could claim it's part of a package and that you wouldn't have bought one without the other. This would be seen as reasonable by a court but they may see it as two separate transactions which it clearly isn't.

I would expect the retailer to be sympathetic to your plight, regardless of any "rights".

    Ask them politely

I would hope so too, but retailers are retailers and I don't do well at negotiation or confrontation, so I was just wondering how clear cut my legal rights are as a precaution/preparation in case he isn't obliging.

It appears that it isn't quite cut and dry, but it's fairly obvious that I would never have bought it without the tent and that it serves no other useful purpose, so I could pursue it further if necessary.

    Thanks all.
