Tax credit overpayment

Hi - DIL just phoned to say that she has had an OP - she phoned them and the guy on the phone confirmed that she had reported a change in circs and a note was made on the system, however they did not action it. He was very upbeat about it and said that he would send an appeal letter out to her and gave the impression that as it was their fault she would not have to pay it back? From reading the threads on here I am not so sure.


Can anyone offer any advice please?

    It's most likely a dispute rather than an appeal.

    Some are successful, some are not. It depends on the specifics eg
    - what was the change
    - when did the change happen
    - when did she report the change
    - did she receive a new award notice
    ---- if yes did she check it
    ---- if not did she chase it up
    - depending on the change she should have expected a change in payment, did she query why it hadn't.
    - when was it finally spotted that it was wrong

    Thank you so much, Dark Sparkle, I was hoping that you would read this? Not sure of specifics yet, not had chance to ask her as I am at work. Funnily enough, from your previous posts I was expecting them to say dispute rather than appeal. I will get the info and post back. Thanks again, I really, really appreciate your taking the time to respond

    All I would say is that there is no harm in disputing. Better for them to say no than to not ask.
