Car written off as Cat C - Want it back on the road

    I notified my insurance about the accident, took the car for another MOT and keep driving it normally like normal.

    I have not informed DVLA and it seems that my car it has not been reported as CAT C by the other party insurance for whatever reason. Nobody rang or told me the next steps so I left it to this.

    Keep driving the car on a daily basis insured and with an MOT so I don't think i need to do anything else. I believe when the insurance will decide to inform DVLA about the accident, DVLA will contact me to declare the car as CAT C.

    There are two different actions you need to go through. One is to inform your insurer and follow their policy and the other action is to inform DVLA about the incident and send your V5C to get updated.

    In terms of informing your insurer, some insurers they will not want to insure such a car anymore (especially if is a CAT C) so if you decide to take it officially with them be prepared to look for another insurer if that's their policy.

    I will suggest find out through the phone what is the policy without giving your details and then you decide what you want to do.

    In my case, my insurers policy was to take the car through an MOT and I am ok to put it back on the road.

    From the DVLA point of view, the DVLA expects me to inform them about this however the accident has not been declared thus I didn't inform DVLA yet. HPI check I did few months ago came back clear.

    arcon5, do you have anything to back that up. I have been in the situation and told the third party where to stick there CAT C for me my car.


    The discussion was this is my damage, this is my losses. This is what I want in settlement. Maybe just the way I negotiated but never had my car CAT C'd in two similar incidents.

    They will either repair a vehicle, pay you money in leiu of damage, or buy it off you at market value per accident, latter being them writing it off and diminishing them from further responsibilities with regards to the damage. Often with the latter they can sell the vehicle back to you

    I understand all that, but I cannot see how a Third Party insurance company can put a DVLA marker on a car without your agreement or authority. They have no contractual right to do this.
  • I would love to know how this was resolved. I am in precisely the same position now - this is how I stumbled onto this post. I will send off the V62 form tomorrow and should get a V5C back. I really would like to be able to drive my car during the time in between. Am I allowed to ?
