I have been in email communication with this company Who I bought a cover for my hot tub off, sent pictures, copy of purchase info, they would not do anything as they were waiting for their supplier to deal with it, after months of messing around, they had offered a year warranty and I notified them the product had failed before a year and could prove it, they sent this yesterday, a final response, what do I do next? The Item was about £275

Hi Paul,
After speaking with trading standards this afternoon regarding the old warranty agreements, issued when the previous company (The Water Cover Company Ltd) were in control of website pools and covers I have been informed of the following:
All warranties issued before the point that we (Saturn Spares Distribution Ltd) took over the website, do not in any way, have to be honoured by us. If the customer does want to take the issue further they would have to speak to the previous owners of the website – who’s accounts are now closed as of December 2015.
This is because of the website itself not being a company of its own, therefore making it impossible to attach legal liability to it. We basically just act as an agent as we sell products through the platform, and are only responsible for upholding agreements that Saturn Spares Distribution Ltd have made.
I am glad we finally have a clear answer to this recurring issue, and we can now move forward from this knowing exactly where we stand.
If anyone feels the need to check the validity of the information in this email, they can be advised to call the trading standards agency themselves and quote REF:1368898.
With this in mind if you wish to contact the previous owners or even the manufacturer who supplied the warranty please feel free to do so. Again the manufacturer's contact details are as follows:
E: selective covers
Kind Regards,
Dave Appleby

If they're a seperate company they have no liability.
Even if they bought out the previous company they may have no liability, it depends on the terms of sale of the (now bust) company to the new one.0 -
what do I do next?
How did you pay for the item?
What is the name of the company you dealt with - who did you pay?
Have you checked the validity of the information in the email with Trading Standards? (It sounds a bit confused to me. Also the website - https://www.tubcovers.co.uk - still has the name of "The Water Cover Company Ltd" on its homepage in a copyright notice, and the following website shows that company as still being active: https://beta.companieshouse.gov.uk/company/07582895/officers)
The website also states "we have been providing the UK with our quality covers for over 30 years". I would ask how they can say that when they (Saturn Spares Distribution Ltd) have only been running for less than 2 years.0 -
As said it all depends on how the old company was bought. It is possible to just buy the trading name and nothing else or it can be sold as a going concern warts and all, that means they buy the old liabilities.
Find the administrator of the old company and ask them.0
