Non satisfied default

I went bankrupt in 2011 and have been doing alot of work to clean up my credit file ready for it all to drop off in 12 months time. All my accounts are now sorted except for a Virgin credit card with mbna. The account was originally showing a default Date of 12 months after my br Date so I contacted them to get them to update it and mark the account satisfied. They agreed to update the date but refused to mark it satisfied as they have sold the debt. So although it's showing a correct default Date is still showing as not satisfied. Will this still fall off my report 6 years after the default date even though it's not satisfied? This is only on experian, the other two don't show mbna they show max recovery with all correct info and satisfied, not sure why Experian is different.

Thanks

As long as it's marked as a default it will drop after 6 years.

    Hi Freddy911,

You can complain to the creditor and ask them to amend this under the Information Commissioners Guidelines about how an account should be marked post bankruptcy (this is from Fermi's sticky): -

    5. When an account is closed, the record should properly reflect the closing payment status of the account and any agreement between the parties

Your record should be closed and marked as partially settled if:
    • The lender accepts final settlement of the account for less than the balance outstanding
    • Your account is included in an insolvency such as a bankruptcy or IVA which is discharged / completed and less than the full amount is paid
If they continue to refuse then escalate it to the Financial Ombudsman and Information Commissioner. You were right to get the default date amended to no later than the Bankruptcy date it will all come off your file 6 years from the entry date anyway, but if you want it to be amended you should complain. Good luck,

    Laura
