bank smart / MIL Collections

Hi all

Im writing this on behalf of my partner a couple of years ago he had a letter from bank smart saying he was entitled to reclaim ppi however after a year he didn't receive anything no updates letters or phone calls from them,

last year he received a letter from bank smart saying he owes them think at the time was £300 after contacting them to ask why being charged when they never got him any money back and never updated him this morning he got letter from MIL Collections saying they have been engaged to resolve the matter with bank smart but the fees have now gone up £656.40.

Any advice on what to do as he feels he doesnt owe them this money

  • I have been having problems with them for years. Last week they told me that I owe them £1993.50. Yet they never got me a penny in refunds. I did all the work for them and told them there was no PPI due to me as I received this from a professional company in 2013. They lied and said they were following up "defaults" which apparently they should never have done. I have been ill with worry and hoping this can be resolved by the Ombudsman.

Subject - FORMAL COMPLAINT AGAINST SYMMETRIC SYSTEMS LIMITED - FOR THE PERSONAL ATTENTION OF BEN SMART AND SIMON SMART - DIRECTORS

I am formally complaining that Symmetric Solutions Limited has instructed MIL Collections Limited to recover a supposed debt of "£[amount] under reference [reference]

    I demand:
    1. One of your directors write to me personally at [address] to explain why you have fraudulently attempted to obtain money from me for a service you never provided.
    2. That you inmediately write to MIL Collections Limited confirming that I do not owe you any money, that your demand was unwarranted, and that they should cease and desist from pursuing it with immediate effect.
    3. That you to provide a copy of that letter
    4. You acknowledge to me in writing that I owe you nothing.
    5. You properly compensate me for the considerable distress you have caused me.
Please note that failure to comply with these demands in full will result in the matter being referred to the Legal Ombudsman.

A copy of this e-mail has been sent to your regulator.

A copy has also been sent to MIL Collections Limited who should take note that FCA rule CONC 7.5.3 R says, "A firm must not ignore or disregard a customer's claim that a debt has been settled or is disputed and must not continue to make demands for payment without providing clear justification and/or evidence as to why the customer's claim is not valid."
