.Little bit of advice needed please, DD2 has had couple of phone calls on her mobile few weeks apart from DRPL (Debt Recovery Plus Ltd). Both times been voice messages and didn't mention her by name.
The first time she rang back without speaking to us as it had worried her. She was asked for her ref no. which she doesn't have one as has never received any formal correspondence from them. The lady asked for her name and vehicle reg which she gave. :eek: But was told no outstanding fines for her. Phew! Just assumed it was wrong no. But now she has had a second call and it's same bloke ringing. I have told her not to answer and to ignore. Is this the best way forward?
I notice they do tracing for landlords but it's well over a year now since she rented anywhere and as far as she knows everything was paid up and cancelled.- some debt companies buy debt at a substantial from other companies and then try to recover the debt to make a profit. (unpalatable to me)
- even if there is a "debt", to be legally claimed it needs proof of debt, a signed agreement etc. No proof, no debt, end of!
- NEVER admit a debt as this makes it legally a debt without proof as it will be recorded, so use the phrase "if there is a debt, which I dispute".
- has DD2 been at the address she is now at for several years? Essentially is the address they SHOULD have, her present address?
- If this is parking fines, the company enforcing the fines would have paid the DVLA a nominal fee for R/K (Registered Keepers) name and address. No telephone number is supplied or D.O.B.
Nitty Gritty to be done.- Try to have all correspondence recordable/printable. Try to get an email address to correspond with them, and use a "burn" email of your own to store evidence and NOT your real email address. If asked by them why email, state she has memory problems due to a medical condition.( think to yourself that being human is CERTAINLY a medical condition). If they ask what the condition is, act offended and say it is personal and she is not obliged to state her condition

- re-contact company, withholding her own telephone number, so it is not displayed.
- If they ask for "security checks", demand them back to prove their identity. Just confirm details they hold, nothing else.
- If DD2 has been at her current address since she has had the car, and that was address supplied to DVLA, she should demand proof sent out to the address on their records, do NOT give over your address just because they ask. Make sure you ask for photo evidence of her car incurring the "fine" and locus/time/date. Yet again this is "proof" you require, you are not obliged to pay for this, onus on them to show proof.
- Also do not state or confirm that you still own the vehicle, just say that she is aware of the vehicle.
- If there is any doubt of this fine being valid, refer them to the doubt, remember it is their responsibility to prove debt, not yours.
- Sorry forgot to also state that emails can take a company a while to respond to, so at the very least it will buy time.
- If the registration is your car, but the photographed vehicle is not, or you have ABSOLUTE proof you were not there and no one else was driving, explain to them and also report to local police. (do not be fobbed off by local police, if you stay in their area and the crime occurred outwith their area, they still need to note it and pass on the investigation to the force in that area) They may not investigate it, but they are obliged to note it is a crime and give you a crime reference number.
- FINALLY, if there is provable debt, do not stump up straight away. Remember they bought the debt at a discount, so haggle for a reduced amount (at least 50%) AND allowable time to pay in installments. ALWAYS get this in writing/email. Keep this evidence for at least 5 years, just in case another company suddenly decides to "claim" a supposed debt.
- Courts will throw out any claims if they have not proved debt to you and the court
If you are feeling like having fun and possibly make money, make up a list of your "charges" and keep a note and invoice them every time for your time. ONLY DO THIS IF YOU ARE CERTAIN THERE IS NO DEBT.

Just a final final reminder. No additional details to be given to them. No acknowledgement of debt or ownership of vehicle, Be POSITIVE. Just like the Elite mind set.

DRPL have as much power as a junior disprin so are usually best ignored. They do all sorts of "debt" but significant amounts of private parking.
They never have any "debt" assigned to them so cannot take anyone to court.
There may be occasion where something needs sorting but in those cases finding out the origins of it and dealing with the original company are best.0 -
