If you want to go down the small claims route, I think you have a good case. And I've told you of my recent experience regarding a transaction that took place on FB.
Things to bear in mind before you do.
It will cost you money. There is a sliding scale depending on how much you are claiming. I think you are looking at £105 to lodge a claim online (recommended) or £115 on paper. If you win, you will be awarded this money back. As with anything, there are no guarantees.
It might not be quick. it takes weeks/months for things to work their way through the system. And longer if the person you claim from makes a counter claim which they are entitled to do.
You have to be prepared to see it through to the end. That means removing any personal feelings about personal matters going on and dealing with the business matter that's causing you the problem...as discussed earlier.
The paperwork/online forms look daunting but they aren't. I will help if you need.
You need to sleep on it and make a decision with a clear head. It's been quite a few days for you. All of that ^^^ needs a clear head and as little emotion as possible:rotfl::rotfl:
Sometimes a letter before action works wonders, as well as not putting you at risk of adverse costs.0 -

I agree. And a letter before Action would be part of my course of action before lodging a claimit's only polite.
As for costs, I don't believe there are adverse costs involved in small claims other than the fee to lodge the claim which I'd never advise anyone to consider unless they had a real prospect of succeeding. Ok there's the prospect of a counter claim, but in this case that isn't really a reality that I think could succeed. if I thought it could I'd be very quiet and wouldn't offer advice
There have been mistakes on both sides here and LS acknowledges that. But her conduct has been absolutely spot on and she's been savvy enough to try and rectify the situation at her earliest opportunity. She's been armed with some good advice and has a good head on her shoulders which will all help in getting it resolved, however that turns out.
Now what is the weather going to be like in Scotland at the weekend?0 -

Well for a case that seems destined for small claims the risk is small, however technically the case isn't on small claims until allocated. There is also the risk that cpr 27.14 (2)(g) is utilised.
Hopefully it's persisting down this weekend, keeps all the riff raff off of the roads and lets me get work done quicker0 -
