Hello!
Viewed a house we like, asked the LA for proof of the LL's right to let. They reply that the LL has provided the appropriate documents to prove their right to let the house, but won't show me because of "data protection". However, they say that they have it on file and it is therefore their responsibility if anything went wrong. What are people's thoughts on renting with this LA? I have been told that I should be more worried about the LL than the LA.

The identity of the landlord and their lender is public knowledge (as they're in the Land Registry), so I'm not sure what data they're trying to protect. If it's just something like the account number I'm sure they could exhibit a redacted version of the consent to you - or just get the landlord's agreement to show you the consent.0

You should be more worried about the LL because that is who you will have a contract with.
As above, you can find the LL name and mortgage interest by downloading the title. However, there is no absolute proof. For example if the LL stops paying his mortgage you can still be evicted by the mortgagee.0 -
Hi,
Thanks for the reply. By landlord's agreement do you mean the AST?0 -

Hi,
The property is being fully managed by the LA, so the only thing I can worry about the LL is his right to let. I have downloaded the land registry, this shows the landlord has a mortgage. But the LA is refusing to show me that his mortgage is a consent to let one.0 -

You misunderstand "fully managed". The LA acts as AGENT for the Landlord. The contract is with the Landlord. The Landlord is responsible for everything. The LA cannot lift a finger without consent from the LL. Anything the LA does do is simply an extension of the LL.0 -
But as long as I agree with the terms of the contract, what else do I need to know? Because at this stage all I know is his name, how long he has owned the property and that he has a mortgage. Thanks0

Why are you hung up on consent to let, rather than buy to let? Are you sure he's an "accidental landlord?"
If he has a buy to let mortgage, there is no permission stored anywhere. Downloading the charges register will tell you the lender's name and some are BTL only, so you might get a clue that way.

His lender is "The Mortgage Works".0

you are not entitled to know what form of mortgage he has and the LA's response is entirely appropriate since you are asking for personal info which they would not be allowed to give outBriCharles wrote: »But as long as I agree with the terms of the contract, what else do I need to know? ask the LL directly - which may, or may not, get you off to a bad start with him if he has opted for "fully managed" so that he does not have direct dealings with his tenants0 -
99% says that's a BTL mortgage.BriCharles wrote: »His lender is "The Mortgage Works".
