Holiday cancellation

I am trying to cancel my holiday due to misleading information regarding the hotel. They refuse to cancel the holiday and advised me to take out travel insurance and claim through that. Is that even possible and isn't it fraudulent?

    If they were seriously suggesting that you take out insurance retrospectively and then try to claim they were advising you to commit fraud.

    I thought this, I have the phone conversation recorded. The guy suggested this to me several times.

    also travel insurance wouldnt cover you because you have changed your mind about travelling, regardless if that was due to miss information.

    What happened was we inquired about a hotel in a certain area and was told it was unavailable but there was another in the same area which was available. Anyway it turns out the hotel is nowhere near the town we wanted and is in the middle of nowhere. Paid with visa debit.

    Why did you accept the alternative hotel?
    What is your definition of ''the same area''?

    Was this done over the phone, are you able to get call recordings to confirm what happened? Have you the option of changing to another hotel?

    This all comes down to whether you can prove the holiday was sufficiently misdescribed. If so then you could go to small claims - a letter before action may prompt the agent to settle before it gets to that stage.
  • Surely you didn't just book a hotel without even looking at on a few websites, or even in a brochure first?
