Hello There
Can I ask the experienced contributors to this forum, on termination of a Flat, rental agreement, how often, if ever, is the deposit withheld, and extra money requested from the ex tenants, in relation to the condition of the said Flat?

It's not really a "how often" question. It's entirely dependent on the damage that's been done.
If damage has been done, I suspect LLs will always take deductions from a deposit to cover the cost.
And if the cost of the damage is greater than the deposit, they will always request the extra money.
If no damage has been done, there's no deductions to make.0 -

If the said flat was left in a worse condition or left with damage upon check-out then I would say that the deposit would be with held or reduced.
Have you made a claim on the TDS that the deposit was lodged yet?0 -

Well, I was wondering if any contributors might have left a Flat in an "as moved into condition", except for a developing damp problem which had been repeatedly notified to the Agents during the tenancy, and then had the result as outlined in my first post.
It isn't me by the way.0 -
Before deposit protection it was a frequent occurrence for my friends and I not to receive all or most of our deposits back. Since deposit protection was introduced in Scotland I have successfully received 100% of my deposits back.
Property 1) LL was actually a decent guy who returned my full deposit - no quibbles.
Property 2) LA tried to deduct something but when comparing the check-out inventory with the check-in inventory it proved the item was already broken before I moved in.
Property 3) The cowbag probably would have tried to deduct something but once I told her the penalties for not protecting my deposit I got the full amount back despite letting Sky drill holes in the living room. (Worst thing I've ever done as a tenant but she made my life hell and I knew there was SFA she could do about it.)
Property 4) LA tried to deduct some money even though the check-out report noted what good condition the property was in. I was ready to dispute it but the LL intervened and told them just to give me my money back.
If you, or someone you know, is having issues getting their deposit returned then they can raise a dispute with whichever deposit scheme it is being held under. Do the tenant have evidence that they reported the damp issue to the LL/LA multiple times?0 -
So are you trying to say they want the deposit and the balance of any work done to rectify a damp problem from you? Cant you just say that instead of two encrypted posts.
Tenants often cause damp problems because they cover up vents or fail to open windows when drying clothes over the radiators or when taking a shower. This is what I expect your person who isn't you is getting blamed for0 -

Just to clarify. My query relates to a couple who are friends.
I have visited them many times over perhaps five or six years in the Flat, and know it reasonably well.
Normally, I would be very happy to relate to them any positive feedback obtained from you guys, as a result of this thread, and also to quiz them on any details you may all bring up, as being required. However, as of Monday gone, I am hoping that they would have sent a reasoned response to the email which they received from the Agents, in which was listed, the Agents reasons for the withholding, and also the request for additional money.
Basically, I am doing this without having consulted them, which was why it was a simple initial request for the frequency with which their position occurs in the rental world these days, as relating to forum members experience.
Your common sense points, with regard to recording the development of the damp, keeping a record of notifying the Agent about it, and of course the protection of the deposit are gratefully received by me. In due course, I will have to find out if they have taken these steps.
