Europarks overstay and appeal

Hey!

I received a PCN for £50 (if paid in 28 days) from europarks for overstaying the 3 hour limit in a Morrisons car park. I (stupidly) appealed saying that there was no justification for the fine and to prove they have lost the amount of money they're claiming for. I got my rejection letter today, the more I'm reading the more I'm thinking I still don't have to pay. Is that right? They now know from the appeal that I was most likely the driver so I'm unsure if they can still pursue me.

Any help would be appreciated.

    They don't know you were driving though, from what you have said. You could have been the passenger.

    So search the forum for 'Euro POPLA' to find a recent example appeal for this stage and make sure you do include 'no keeper liability' (may as well). ECP cases are fairly easy to win at POPLA.

    Show us your draft after reading several other Euro POPLA example drafts others have used in 2016 (not earlier ones).

  • Thanks both of you, I wasn't sure where I stood since I'd already appealed through their internal process and if that opened me up to having to pay since it implied I was driving. I'll go through POPLA and see what happens!

    That's fine, but don't go 'writing your story'; your POPLA appeal must be constructed using technical and legal points. All covered on the forum. Essential reads to get you started:

    * NEWBIES FAQ sticky - post #3

    * POPLA Decisions sticky - read only the most recent posts, say from April 2016 onwards.

    While this is relatively straightforward, it's not 'painting by numbers'; you will need to do some research and develop an understanding of how this all works.

    Draft your appeal and let us see it for fine tuning before submission to POPLA.
