In all honesty, I believe you are wasting your time.
The car does not drive sideways and he collided into the side of the car. He has a continuing duty to keep a proper lookout and has most likely failed to do so having made a cursory glance to his left and then set about peddling across the road.0 -
Secondly the nurses report from the hospital says " he rode into the car" ....he collided with the car he didn't ride into it !!!
In your opening post you stated that he was riding his bike and he hit the drivers door, therefore he rode into that door.
It's no different to saying that if your son was in front of the car and it hit him, the car would have driven into him.0 -
Im curious what exactly your claiming for? Presumably its not loss of earnings?
(aside from that I agree with the other posters, it was your son's fault, from your description)0 -
I don't see how you've got a claim here. The car was travelling along a road, your son crossed the road and collided with the car. I don't think it matters how fast the car was going as your son appears to have ridden into the side of the car, rather than being hit. Maybe we're not getting an accurate description of what happened here?
Why do you think the car driver was at fault?0 -
Why was he checking for traffic before he got onto the bike, rather than when he was ready to cross the road? It's a bad move even if there's good visibility, and even worse if visibility is poor.0

Personally, I would suggest forgetting about a possible claim and take it as a lesson in life and just be thankful that your son didn't pull out a fraction of a second earlier.
If this had happened, the car may well have hit him side on and the outcome would probably have been far worse than a broken collarbone.0 -
After reading your story i thought you were going to say the MIB were pursuing a claim from your son.
I'm both a cyclist and a driver myself and from what you've told us, it appears your son was negligent. It sounds like he wasn't be observant enough. It might have been partially the drivers fault if he drove into the side of your son's bike, but it seems the car was driving on the road normally and your son drove into the side of it.
As has been said above, i don't think it's worth pursuing with the MIB as it doesn't appear the driver of the car was negligent.All your base are belong to us.0 -

We made a claim against the MIB through a reputable company, but the claim has been rejected.
Ambulance chasing company?
Without going into the whys and whats of the incident normally you would make a claim against the Insurer of the vehicle involved unless it was a hit and run or the driver was uninsured.The man without a signature.0 -

What reason did the MIB give for denying the claim and do your legal team agree with the MIB's decision or have they explained to you why they think the MIB is wrong.
Have the MIB mentioned that the refusal has anything to do with how your legal team presented the claim or in any advice they gave0
