Returning a dress after 14 days

I bought a prom dress for my daughter in April for her prom next week. We realised at the weekend that she has grown and it doesn't fit her properly anymore. We returned to the shop today with the receipt but were told that they will not exchange it (or do a refund) even though it no longer fits her because we bought it over 14 days ago.

Is this legal? Even though it is no longer fit for purpose because it doesn't fit her anymore?

    You have no legal right to return a product just because you no longer want it.

    If you purchased it in person and the store doesn't have a returns policy in which it would fall under, then unfortunately you have no right to return at all - whether before or after 14 days.

    Is it possible to get alterations done?

    Your getting mixed up. Fit for purpose is in regards to the item having a fault, not being inappropriate for your needs. That is always your responsibility.

    Legally even if you'd taken it back the next day there would have been no requirement for them to refund/replace unless the store terms dictated otherwise. The store are in the right and you've no rights here. I'd suggest looking to get the dress adjusted.

    As the dress was purchased a maximum of 10 weeks ago, I can't imagine that your daughter would have grown too much in that time so in all likelihood, it will probably only be small adjustments that are required.

    Sound like you're getting slightly mixed up yourself ;)

    Not fit for purpose doesn't mean the goods are faulty. It means its a physical impossibility (whether faulty or not) to use them for either the purpose for which they're commonly supplied or a purpose the consumer specifically made known to the retailer at the time of purchase.

    ie a water bladder made from mesh netting thats physically incapable of holding water or asking for a bluetooth headset that allows voice dialling only to be given one that doesn't support that feature.

    Really? OP said their daughter had grown, thats not necessarily around the waist. What makes you think she's put on weight rather than perhaps her body undergoing the same changes everyone undergoes as a teenager when their hormones change? ie boobs & hips developing.

    Also, unless you have intimate knowledge of someones health & weight, I'd refrain from ever telling anyone to go on a diet. Especially a teenage girl!

    Thanks for all your replies. It's not that we don't want it but that my daughter cannot wear it because she has had a growth spurt (not got fat). The problem with altering it is that it is boned which apparently will make it difficult to alter and so far I haven't been able to find anyone who has the time to try to alter it before the prom. The shop assistant did suggest something I could do to the dress which I think I will have a go at myself.

    I think you're probably going to have to make the best of it, kids grow, and it's not the retailer's fault that it was the wrong size. There may be some advice on other form boards here, maybe the 'old style' board, that has some creative people?

    Not getting mixed up in the slightest but thanks for the clarification. My point still stands, the goods are perfectly fit for purpose in this case.
