Incorrect Notice of Transfer fee

we have recently (April) completed on a leasehold property purchase, as far as we knew everything was taken care of however we just received a letter from our freeholder stating

"We have received the Notice of Transfer from X solicitor to be receipted and returned to them but the registration fee was incorrect"

According to our lease we should pay a 0.05% of the purchase price which is approx 5x what the solicitor has paid. The freeholder is asking us to make up the difference by cheque to them.

I have contact my solicitor about this and waiting to hear back but in the mean time looking for some advice if I should need to pay this, It seems like an error that the solicitor should be liable for? After all we have been paying them to deal with stuff like this properly...

    Have you suffered a loss? For example:
    Are you being asked to pay some kind of additional 'admin fee' or 'late fee' because your solicitor sent the wrong fee?

    Or did you pay your solicitor the full fee, but they only passed on part of the fee?

    If you've suffered some kind of loss, you might have grounds to claim from your solicitor.

    But if you're just being asked to pay what you should have paid anyway - and you've suffered no loss, you should just pay it.
  • I need to try to establish if we paid

    a) Nothing
    b) The amount they transferred to the Freeholder
    c) The amount requested by the freeholder

    I don't see any specific reference to it on the statement so i guess it may be a unfortunately?
