Likelihood of CCJ/Charging Order whilst on DMP

Options
Evening everyone,

Being on a DMP, I worry about the possibility of CCJs and Charging Orders, however whenever they are mentioned on this forum it seems to relate to either mobile phone contracts or when people ignore their debts.

So what I would like to know is if anyone on here has received a CCJ or Charging Order whilst paying their debt back via a DMP.

I am hoping I don't get too many responses :-)

Depends on the lender, and how much you owe them.

If your paying it back via a DMP, then it's unlikely any further action will be taken, unless it's say tens of thousands of pounds, which is unlikley on an unsecured debt.

    Hi

It’s possible but I haven’t heard about it happening very often.

    hi

started my dmp with stepchange 6 years ago, with about 10 creditors .
mbna issued a ccj attached to the house .Not the biggest debt or smallest and also my partner had an account with similar debt ,no ccj ?
my concern which i didnt realise is when the debts are defaulted at the dmp start some take 6 months others take longer! and thats when the 6 years start!

    Hi Gal,

Did MBNA issue the ccj or was it a dca?

    Thanks

Op, I think you asked a similar question a year ago and I replied then as I was going through it with Nationwide. I have a CCJ from them with a charging order over my property, but as they stressed many times they didnt expect me to sell, but if I did I would have to pay them back out of the proceeds, which would be easy to do, but as I am not selling it makes no difference. Yes it felt stressful at the time but I didnt attend any hearings, just filled out a form and it was all quite painless. It must have cost Nationwide to apply for it presumably but maybe they have some sort of blanket formula they use for deciding on CCJs, i.e. if they believe someone has a lot of equity in a property, either way it doesnt affect what I pay them each month and the DMP continues as normal.

Thanks Coinmachine, have you tried to remortgage since having the charging order applied?

Not tried to remortgage as luckily I have a base rate tracker.

we did. From Northern Rock, who were always the worst of our creditors to deal with. yet despite being on a DMP, and taking out a Charging Order they never defaulted our loan. Which was very naughty of them and we are currently fighting it.

    hi Kid 77
It was mbna who took me to court via restons, the dmp started in the september ,two vists to the court ccj issued following sept
i have about 10 creditors the amount i owed was not the highest with mbna and as said before my partner had a card with mbna for a similar amount ,no action
6.5 years into dmp thats the only ccj i have which drops off my credit report this september
    hope this helps.
