PPI query

Hi, I have already managed to claim back over £7K for missold PPI, however I have a question on whether I can claim again? My husband and I took out a mortgage with Northern Rock in January 2005 and took out a Mortgage and Payment Protection scheme through D&D Homecare Limited (Disability and Unemployment cover) and Mortgage Decreasing Term Assurance with Legal & General for both my husband and I for 6 months. We then to moved to Abbey National - another query which I will do separately.

    You can complain about anything you like assuming you've not complained already to whoever sold you the PPI & DTA protection policies - what are your complaint reasons - taking out cover for a mortgage is quite normal.

    Obviously, one of those is not PPI. So, making a PPI complaint on a non-PPI product would be daft. The other is but would have been made via a broker I believe (based on provider used).

    So, what exactly are you alleging that the broker did wrong? (remember that most MPPI complaints fail and most broker complaints fail. PPI is not seen as a mortgage broker/adviser failure and have very few PPI complaints awarded against them. Indeed, the FSCS only uphold 5% of complaints against mortgage brokers to give you an indication).

I have looked at the Personal Protection paperwork that the Financial Agent did for us and we had agree that no protection was needed as we had already taken out insurance for this through Scottish Widows. However, then received the Mortgage and Payment Protection scheme through D&D Homecare Limited (Disability and Unemployment cover) and Mortgage Decreasing Term Assurance with Legal & General for both my husband and I for 6 months. We moved to Abbey National because we felt that we had been missold the mortgage. Therefore my question was could I claim that if the mortgage was missold then both these plans were not valid either?

    Technically, no. Because all this happened in 2005, and if you believed that you had been missold these products in 2005, your claim would now be statute barred.

    Hint: if you want to make a complaint, you need to have a good explanation of why it's only now that you've realised you've got a complaint.:)

    If you have PPI with Scottish Widows and it was duplicated then you have a case. However, SW is a life assurance company (not a general insurance company). So, theirs would have been life assurance, critical illness cover or income protection. So, no overlap with PPI. Did the SW policy match the mortgage terms exactly? (same time and amount assured)
    Therefore my question was could I claim that if the mortgage was missold then both these plans were not valid either?

    No. You are timebarred (6 years from sale or 3 years from being reasonably aware of an issue - change would trigger the 3 year clock).
