Employer charing for personal info

Hi all,

I am trying to obtain information from my previous employer as to the information they hold about me. Pay, taxes, dates and so forth.

They are trying to get me to pay for this through a subject access request. Surely this is not the case as this is my basic employment info.

I understand SAR's and their meaning for organisations like the police and courts, however I have repeatedly asked for this information from them previously however now the threat of legal action looms they are trying to charge me.

Can anyone advise who is in the right here?

    Depends on what the issue is?

    Could you reconstruct that information with the information you already hold?

    You should have a copy of your contract already. If you no longer work for the company and the contract is no longer in force they don't have to give you a copy.

    Pay, taxes, dates and so forth....you should already know that or have a rough idea of them. The HMRC will have a record so you could try asking them instead.

    It's a maximum charge of £10, if you are going to face imminent legal action it would seem sensible to pay it rather than waste time arguing.

    I have been trying to get someone to respond to contact for some time now, I was effectively pushed out of my job through fear and I now want to take it further.

    Sadly, I have had to use the threat of legal action for them to pipe up (It only took 5 months).

    I'm looking for information relating to start/end dates, pay and so forth. I have a copy of my contract, however it is dated long after I started.

    How are you proposing to take it further? If you are thinking of an Employment Tribunal you only have 3 months after incident or employment ended to bring a claim, Given you are saying it has taken 5 months you are out of time.

    Surely you know when you started and ended your employment and your pay or at least can reconstruct it anyway. Also not sure how this would be probative if you are claiming forced out of your job anyway,

    Returning to original question yes they can charge for SAR however often choose to waive as can only charge £10 maximum.

    None of these things would be relevant to making a claim of constructive dismissal (which, since you claim to have been forced out of your job, it must be - you imply that you resigned). But as the previous poster has said, it would appear you are out of time to make any claim. Unless you can say why you think otherwise, save the £10 because it is better off in your pocket than theirs.

    Save your energy, some fights aren't worth the hassle.

    By taking it further I am trying to reach the CEO. I was a senior manager at a local level, however my situation has been negligently dealt with by one single person at head office who is trying to cover their tracks.

    This individual has cost me thousands having been bullied by them however due to their position within the company I need to find a way to skip above their position and take it to the top.

    As much as I'd like to be compensated for being forced out of a job at Christmas I just want this individual to be dealt with by those above him.

    If they didn't know your name at the time of your employment I doubt they'll give a jot. That's why employ HR teams, to handle employee issues so they don't have to.
