Refund Challenge - (Currys) Device + Rolling Contract -

They are not playing games, you have no rights here. It may never have been in their store so you cant possibly say they are lying
It's clearly available on their website - it can be ordered to store,
At a minimum he was incompetent. The product can be made available at that store, but he took the option off the table. I was naive enough to trust his professionalism/integrity.
Oh - and during the discussion whilst signing up - he mentioned he had worked there for 14 years.
Pc World/Currys CS is appalling when compared to many other retailers.
Summary - Yes I have started using some of the data allowance - but only some. I am within 14 days of signing the contract. I purchased this unit - because I was explicitly told an untruth, that the alternative I wanted was not deliverable.
I'll see what I can do then get back and post the outcome.0 -
Basically - Instore, I had asked if they sell the 'non-mini' version of the device - i.e the full monty 'big brother' version - but the chap salesperson said "no - we never have". I settled for what he advised. It's clearly available on their website - it can be ordered to store,

I can't understand why you're getting so worked up. Based on what you have said, he was correct in what he was saying. They have never sold the item you wanted instore.
Expecting someone to know every product they sell instore and online and insulting them if they don't is a little uncalled for in my opinion.0 -

Why did you not do your research before buying said item, as you have opened the item and used it you cant return it, maybe try selling it on ebay.0

OP you seem a little hung up on the 14 days - unless you purchased at a distance or there was a finance agreement involved, there is no statutory 14 day cooling off period.
All sales in a shop should be considered final unless the retailer offers a returns policy and your return would be within the T&C's of that returns policy.
If you'd purchased the item online then you'd be able to return - and you'd either be able to cancel and get a full refund or (if you requested provision of the service began early & they advised you of all necessary information under the CCRs) just be liable for the period the service was supplied.
The sales rep saying they don't sell the item wouldn't even be covered by the CPRs imo as they haven't lied about your chances of sourcing the item elsewhere. Even if they didn't stock the item you really wanted, you were still free to go and look for it elsewhere.
That being said, theres absolutely nothing to stop you from asking them for a goodwill return. The worst they can say is no! Especially if you're looking to trade up rather than just return. You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0
