Restrictive Covenant Indemnity Policy - A Con?

    Only caveat to add re TBagpuss's post is that digging around too much into what the covenant might be or who has the benefit may invalidate any indemnity or the chance of obtaining a new policy - I may be wrong but have been picked up on that point myself when posting before re such matters.

    I'm guessing the register refers to a Deed from 1924 but no copy was provided or filed for example. There can be other protective entries such as may be subject to any covenants that exist prior to [1924] as well and all depends on what was supplied/registered at the time.

    Risk is real so it would never be a 'con' in my experience. You simply don't know what might happen in the future re the covenant(s) and whilst the risk may seem negligible it still exists.

    Thank you for the advice. I have directed the solicitor to go ahead and we will 'wear' the cost. I'm sure we will we recoup it in a hopefully pain free transaction....!:D
