PPI reclaim lost loan agreement

Hi,
I had a loan in 2009 with rbs. I tried to check if I had PPI in 2011 (requested my loan agreement under section 77) but I received a letter saying they could not find my loan agreement. The letter stated that due to this they could not enforce the agreement until they find the document to comply with section 77. It also stated that I should continue to pay the loan or risk being reported to credit agencies. Therefore I continued to pay to loan off which is now fully paid but I had still not received a copy of my loan agreement from the bank.

Fisrtly, do I have any grounds to reclaim any of my loan as the letter I received stated it was unenforcable and I still haven't received my agreement?

Secondly, what should I do with regards attempting to claim PPI again?

    No. You paid back the loan, so you're all square on that front. No one needs to pay anyone anything more.

    You could ask them again if you like, but it doesn't sound like they have the data.

    The reason you got that letter was because they thought you were trying to pull a fast one and get out of paying the loan.

    If it was taken in 2009 then it is unlikely that you had PPI anyway as nearly all the main banks had stopped selling it with loans at that point. I think single premium PPI was actually banned later that year.

    No. As mentioned above, the letter was to cover themselves should you have decided to try it on. The method you used is typically used by people trying to get out of paying their debts. However, after the court case ruled that the lenders could use reconstituted copies, that scam by some claims companies ended.

    You have never needed the agreement to make a PPI complaint.

    OK, thanks for the replies. Yes I sent the letter after reviewing online as I only have a copy of the pre-contract information, Which doesn't say anything about PPI.
    The reason I'm now checking us that another company (stanton fisher) have contacted me about potential PPI refund. I realised this will be just another attempt for them to make some money, but are they ever worth using these companies?

    Of course they aren't worth it..


    Bank finance taken as late as 2009 is very unlikely to have had PPI anyway...
