RBS - Cabot

Hi there,
I've just received a letter from RBS stating that my credit card debt has been sold to Cabot.
In a nut shell i defaulted on this around 2008/2009 - furthermore according to clear score and noddle there is no default on my account for this debt,
What are my options? - I dont have the funds to pay will they enforce a default / CCJ - its a very soft letter asking me to contact them and all the wording is we may take further action but no decisive action points.
I will check my records later - if i've already received a default which i'm pretty sure i have - what can they do?
I have a few other defaults which will be falling off within the next 18 months which i make my small payments to - which by my previous thread i have to keep paying after my default falls off as they could apply for a CCJ.

Did you acknowledge the debt anywhere between the default date and today? If at any point you did then it will not go away on it's own and they can still go and get a CCJ against you.
So the best first step will be to reply to them and ask them to prove the debt. Then depending on the response it will either clearly show that it is older than 6 years (and doesn't include any proof of you acknowledging the debt) which means you can reply and tell them to pound sand as this debt is now statute barred.
But from the sound of your post you keep making payments to the defaulted accounts, and if you did pay to that one too then it will not become statute barred for 6 years from last payment/acknowledgement. If that is the case, or they will reply to proof of debt with proof of payments/acknowledgement of the debt then you will have to pay that debt. And best way to do that will be to either negotiate with them, or maybe reach out to http://www.stepchange.org/ for help if your total debts are very high and you need help.0 -
after reading numerous threads here i told that CRA remove the defaults soon as it hits the 6 year mark.
Im paying off 3 defaults currently one of them i had a Tomlin order. in regards to the RBS i did not make any payments (i will double check this) and this is not on my credit file therefore should it go away? I did a few years ago ask for a signed credit agreement and they went quite. Of course i will dig out my old paperwork.
On a wider note i need my file cleaning up, 3 of my 4 defaults will be hitting the 6 year mark in 18 months - i need to ensure this happens - although ive been paying towards them for sometime i need to know if im on the right path.0
