  • I'm in the same boat. Contacted CAB today ive posted on their Facebook post with more info on list of potential damages which can be pursued. Look for post with #Shamebase!

    Their T and Cs seem to conflict as it states payment will be taken after card details and stock availability checks. 6 weeks of holding on to ££££s from zillions of orders. Something is not right. Read on fb page that the retail ombudsman have advised someone that Homebase have refused to deal with them - if that's the case what is the point of the service.

    So they did the stock availability checks and then took the money.
    Does it say that their 'stock availability checks' must have a positive result before the money is taken?

    My understanding is that The Retail Ombudsman is just a another limited company trying to fill what they perceive to be a gap in the market.

    As it says at the bottom of all their webpages:
    The Retail Ombudsman is a trading name of Consumer Dispute Resolution Ltd (Company No. 09189773) 286 Euston Road, London NW1 3DP

    Thanks for that - had a quick read so the Ombudsman if I get the jist has a Director of Communications who has difficulty communicating plus has a very professional hotmail address as his primary email and then I just loved paddyrg comment if you are not happy with the service can you get them to arbitrate with themselves :rotfl:

    Sounds as though this outfit will give some of Walt Disneys characters a run for their money - no pun intended ;)

    I’m in the same boat. Homebase contacted me yesterday to say my order had been cancelled. This was only because I had emailed them to ask about my delivery time for next Saturday, when my order was due. They have now had my money, which was paid on a credit card, for 7 weeks and 4 days. It’s still not been refunded.
    I did some research to find out if this was lawful and found this: Under the distance selling regulations, the goods must be delivered within the time period they have specified. If no time period is specified, then the statutory time limit is 30 days (unless you have agreed otherwise). If the supplier is unable to do this, they must inform you before the end of the 30 day deadline.

    So you are saying the regulations state that if no delivery date is specified, the seller must say so within thirty days.

    You then tell us that Homebase had advised you of a delivery date of next Saturday. So they had advised you of a delivery date.

    So what's the issue here?

    You bought some goods from Homebase, agreed a delivery date and also agreed to their T&Cs.

    Have you read those T&Cs?

    One of those conditions that you agreed to is:
    2.3 Acceptance of your order and the completion of the contract between you and us will take place on dispatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it (please refer to Returns and refunds).
    Now, just because it is written in T&Cs does not always mean that it is enforcible, but in this case it is perfectly legal for the buyer and seller to agree when the contract is formed, and you and Homebase have done just that.

    As the contract is not in place until the goods are dispatched, Homebase have every right to refund you your money, quite simply because you agreed that position at the time of purchase.
