Esa and sp2 credits

Does anyone know the rules for SP2 credits whilst on ESA. I have a long running dispute, 2 years with the |DWP. I attended a tribunal today and am no wiser. The judge said the DWP were too complicated and adjourned the tribunal to ask the DWP what law the DWP are using not to pay me.

The DWP did not attend for the second time at a tribunal. I was on contribution based ESA from May 2011 until July 2014. My actual payment stopped at the end of May 2012.Because my wife had a part time job I could not claim earnings related ESA. The DWP keep changing the reasons why I am not receiving a SP2 credit for 2012/13 although they are giving me a credit for 2013/14.

Their excuse this time is that because my payment ceased in May and continued the credits are not continuous and 8 are only towards my basic pension and 44 are credits for Sp2 and that I have to have 52 continuous credits to receive a SP2 credit for the 2012/13 year although I was in the work related group for the whole tax year.

The law relating to SP2 was changed in April 2012 and a flat rate accrual amount paid to people on long term sickness. But the law is so complicated it is difficult to work out the true entitlement.

As usual the DWP try to blind you with quotes of the law. They have made so many mistakes telling me I was getting a credit for one year and changing that stating I was getting it for another, that it is difficult to work out what is fact and what is bull s**t.
