You can't force them to cooperate with each other.
You could suggest that you solicitore speaks to theirs andpoints out that they can complete the sale and have the money held by theeir own solicitors until they reach agreement on division, but you can't force them to do so.
Yoi could also ask the Wife whether there is any court order, as it is just possible that there is an order and that he is trying to pressure he to agree something diferent, but it seems more likely that they have not got a formal agreement in place.
If there IS an order then the wife could apply to the court to enforce it, which could include getting a Judge to sign the paperwork instead of the husband, but that could take several weeks.
Unfortunately, either party can withdraw at any time up to exchange.
Is the hisban living in th house? If he is not, then giving them an ultimatum to walk away if xchange doesn't happen within (say) 7 days might work. If he is living there however this would play into his hands as he probably wants to stay there. All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)0 -
Today's update....we have given them until Monday 5pm to give us a definite date for completion else we are pulling out.
The husband doesn't live there it's just the wife.
We were under the impression that he had signed but he obviously hasn't!
Been into the estate agents today and they are trying to get hold of him to say he is being silly and needs to complete then have the discussion about the money.0
