Ineligible for Housing Benefit

Hi all,

Going on from a thread regarding gross misconduct and dismissal, I'm in need of some further help.

O/H is currently suspended for gross misconduct. From the various GOV websites, he will not be entitled to JSA right away due to the circumstances.

We were in the process of buying a property, that has been cancelled.

They will not receive HB as I have approx £20k in savings and they have approx £8k.

Now, if I were to purchase a property of my own that I could afford to run efficiently on my own, I assume they can live with me without claiming HB?

I know there are rules about 'detriment' but if I'm not the one directly affected, would the LA actually be entitled to come for me?

    Not really sure what you're asking.

    Anyone can live with anyone.

    Are you saying he'll give his 8k to you to help buy the house? They'll still count it when assessing him.

    I guess if he was to apply for HB after I buy the place, my savings will be less so not able to be relied upon. I guess I'm asking by using my saving to buy a house in my name, I'm not going to be seen as fiddling my accounts to give him a better chance of receiving HB?

    Does anyone know how it's assessed?

    You mean you're going to charge him rent on your home and want benefits for that?

    It'd contrived as you were previously going to purchase together, not be his landlord.

    He will not be able to claim HB when living with you, irrespective of income or capital levels.

    Your partner can of course live with you.
    Your partner can't claim any housing benefit/LHA whilst living with you. You are not his LL, you are his partner/wife.
    If eligible, your partner will be entitled to apply for CB JSA and his and your savings won't affect his claim.

    Savings are probably not even relevant here as your level of income would affect any benefits as you are treated as a couple for means tested benefits

    HB for where? if he is living with his partner in a mortgaged property there is no liability for rent so no housing benefit.
    Is he remaining in the rented property when you leave to move into your own place? are you separating?

    Just clarifying. He lives with gets no HB due to being partner.

    I can live with that, it's what I was expecting. Just needed confirming.
