credit card continuous payment: 123 Reg

Hi - anyone know about the legalities regarding continuous payment authority - when a company simply uses a card you used ages ago to take another payment? In my case it's 123-Reg the domain name biz. My bank says they are notorious for taking payments in this way; in my case the domain renewal date is not yet here - yet money has still been charged to my credit card. I feel a battle! Not great! Thanks for any help.

    If you agreed to a CPA, then it's valid.

    If you didn't, then it's not. Check the terms of the agreement.

    If that's what the terms say, yes. It wouldn't be unreasonable to expect payment at least a little in advance of the renewal date.

    Having dealt with 123-Reg for many years, I can confirm they always seem to take payment and renew domains 7 days before they expire.

    The applicable law would be contract law - in whichever country the contract was formed.

    But the short answer is... you agreed to their contract terms. So read the contract you agreed to, to see if they are sticking to those terms.

    I signed up to a monthly CPA recently via a website and forgot my logon details. After a second payment went through I called the company concerned and tried to cancel the payments "going forward". I failed security and they said they couldn't help. I said I would cancel with my CC, and they then said to send them an email.

    I sent an email but also phoned MBNA. MBNA happily said they would reverse future payments should they be attempted. The guy was very keen to bounce the one that had already gone through on the basis that I didn't really want a CPA. I told him not to, I felt that that would be a bit unfair.

    The merchant eventually replied to my email in "foreign" English saying they had located the account and wouldn't take any more payments. They sent this a day after taking another payment. Looking at my MBNA account, they have already bounced this.

    So........... if you really feel hard done by, and your CC rep is anything like the MBNA rep I spoke to, they seem more than happy to reverse a CPA payment that has already gone through, even if really you authorised it.

    What your merchant will make of that is another matter!
