Confused with solicitor queries!

Hi,

Just a quick question - we've had homebuyers report etc done and mortgage offer received.

My solicitor sent me the contract, mortgage deeds, fixtures and fittings and other associated documents last week. I had a few queries about different things so I have raised those with the solicitor to pass on to vendors solicitor.

My question is - should I wait until the queries have been answered before signing any of these documents? Or should I sign and send back anyway?

    Send back straight away, your signature doesn't mean anything. Once the sols have the docs and everything is ready to go they'll proceed to exchange, that's when it becomes binding xx
  • Personally if I had queries directly relating to information/details within the documents that require signature, I'd wait for a response before signing so I fully understood what I'm putting my sign on the dotted line for.

    It won't be binding until the contracts are exchanged. I've signed, and then later pulled out of the purchase.

    Though if you don't sign, your solicitor can't mess up and exchange without your permission (even though they require you to tell them on the day to exchange).

    I know this isn't your main question... but asking questions via solicitors is a slow process.

    Depending on the questions, it's often quicker to ask the seller (maybe via the EA) - and then just tell your solicitor to confirm the answers.

    For example, it would be painfully slow to enquire via solicitors whether the cooker, fridge etc are included in the sale.

    It would be much quicker to discuss this with the seller - and if they are included, then tell your solicitor to ensure it's in the contract.
