My car gave up the ghost a few weeks ago, we needed to replace it asap we found an identical one on Gum tree with a private seller. My husband paid the man from his credit card into the seller paypal account the amount of £800 the rest we paid in cash (£400).
The MOT was done on the 13th May we bought on 22nd it had 2 minor advisories.
The car needed to have the side step rails fitted, (it's a large car as I have a disabled family member who needs the room as well as 3 kids). We took it the mechanic to fit the rails; he has advised us this morning that the MOT on the car must be a fake as the car had obviously been in some sort of collision and chassis is bent along with that there are a number of defects that would not pass on an MOT.
My question is are we able to claim back the money via S75 on our credit card from a private seller?
We really can't stand the loss of the money or be without a car I'm so distraught.

  • You can check if the MOT is legitimate online: https://www.gov.uk/check-mot-history

    If the MOT is correct you might want to contact VOSA for more advice. If it is a fake then speak to your local police although you will most likely have to sue the person in the small claims court.

    Unfortunately, you can't claim on S75 as you paid Paypal, not the person. You might have some luck with Paypal though - give them a call.

    Have you actually spoken to the seller rather than come on the internet to post?

    It is always worth letting the credit card company know about the problem and asking nicely if they can help. There might be things they can do, although basically you have no rights as explained in post above.
