    I wasn't suggesting that he /she shouldn't. I was suggesting that they need to pursue the claim & establish that they were not at fault (assuming, that as they said this is the case) otherwise when any new insurer looks at the accident record they will not I suspect be given the benefit of the doubt as a none fault claim / incident when that insurer tries to rate it.

    There will be no doubt about this. If it is a fault claim that is how it will go down on the OP's record on the database (conversely, if it's "no fault" then it will be logged as such)
