Just had a row with landlord
He not giving deposit back and it was not in the scheme
If I go court is he first in breech of contract or does it not matter who breeched first as I not paid rent
I won't pay full month rent or not accept he won't pay my bond even to cancel out missed rent0 -
I'm not surprised you've had a row given that you seem to be ignoring all the advice here and sticking to ""I won't pay full month rent".
You owe the rent so should pay it (unless another agreement is reached which now seems unlikely).
In what way has he breached the contract? Even if he has, you can't use the "You breached it first." arguement. 2 wrongs don't make right.
Stubbornly saying "I won't pay full month rent" even after all the answers you got here is not going to help you.
As for the deposit, have you read:

Surely if your 12 months started in August 2015 you can't serve notice before July 2016 anyway?0

Good point well made. The fixed term ends 16th July 2016 and the OP is liable for rent up to then unless there is a break cause he/she is invoking.0 -

He has not said it was a 12 month tenancy- may well have been 6 months then periodic.I have had tenancy for one year.
My contract started on 17th of August 2015
Hence in my post (8) I said:
Pixie did ask back in post 3 ("Length of tenancy") but this was unanswered.However, assuming:
1) the tenancy is in Eng/Wales, and
2) is monthly periodic (rolling), and
....
Furthermore, the LL appears to have accepted the notice - it is the tenancy end date (and/or rent end date) that is in dispute.0
