Btw I do thank you all for your help however painful it is, it just seems so unfair, but don't tell me insurance is a business money driven, nothing to do with being fair. At least tell me you can see how I feel it to be unfair?0

You need to read your policy to see if it covers you for accommodation for your tenants.
The insurer won't insist you tank your side but if something isn't done either by you or your neighbour, and water ingress occurred again due to the same issue, they won't cover any damage at all.
You pay your policy to cover you for certain damage etc. All policies Have exclusions such as wear and tear. Therefore any damage relating to that won't be covered under your policy (ie kitchen units).0 -
if i do claim on my policy when i renew with a different company will i have to state i made a claim even if the neighbours insurance paid it?0

Yes. You will have to state you had a claim, and that the costs were recovered.
The way it works is that you claim on your policy, the insurer pays out on the claim you pay your excess and lose your NCD. Once the claim is settled THEN your insurer try to recover their costs. If your renewal is before they recover their costs, then it counts as a claim.0 -
