Lioness twinkletoes, we have tried to help my mother. She is not "elderley" she is 53. A fine young age. I am not in this for " financial gain" i am merely looking for some action for this LL's uncooperatice behaviour. He has had plenty of chances to put his house right, never has. So don't give me lectures on what i should and should not have done. And accusing me of "trying to make a few quid". The LL has brerched my mothers human rights. Incase you didnt read the council were not interested. They have put her on the lowest band possible. If i was trying to make a few quid, why would i ask for help on here? I would be doing everything to get £ direct from him. Please refrain from commenting on my post. Idiot.0

Mum has lived in this desperate house for 20 YEARS. She could have found another home, privately rented, in that time. I seriously doubt the situation is as bad as you state or she would have moved.
Waiting for the Council to house her is like waiting for Godot. Help your mother find a new home. Stop chucking phrases like 'breached her human rights' around as it makes you sound foolish. No human rights have been breached. She could have moved. She chose not to.We are not after money, we are after the LL getting some sort of punishment for going back to india, collecting rent money and avoiding his tennant. I can count on one hand how many times i have seen him.
Best way to hit him in the pocket is for your Mother to move. I now suspect she's hanging on, hoping complaints to the Council will result in a social housing home. It won't. They will compel him to carry out repairs and that is all.0 -
Hinton, it would really help the most knowledgeable posters here if you could supply the information Artful has asked for a couple of times. If your mum has been in the property so long, it is certainly possible that the notice she received is not valid. There are ways of getting landlords to do things BUT you have to follow the correct process. In order that the wise people here can help you, please could you give the information.
I am not interested in the "how" or "why" questions as you have provided enough information. What we need to know is when the tenancy started, which country the property is in, and any documentation your mum received when she moved in. It's not because people are being nosy or judgmental, it's because those facts are needed for appropriate advice. I hope this explains and that you can post those details.0 -
Tennancy was started in 1993, property is in england, cheshire.
When LL issued S21 last year he gave her a new 6 month contract.0 -

It is important you find out about a s20 notice been served on your mother or not
Assured Tenancy ?you moved in between 15 January 1989 and 27 February 1997 and your landlord did not give you a notice (section 20) saying that you have an assured shorthold tenancy
If a section 20 notice was Not issued at the start of the tenancy, LL cant evict using a s21.

If one of theses notices was served on tenant when the tenancy 1st started and LL would have to prove this in court, then they can use a s21.

Thank you ever so much 45002. I am very sure this is what they call a retaliation eviction he is trying to do. The whole system is a joke to be honest.
How he has got away with the heating and hot water, gas check at the very minimum is beyond me. When we notified the council a few years ago they were not bothered then either.

I assume she's working at 'a fine young age' and should be able to find another private rental if necessary.
Please stop being so intent on hounding your LL, your first priority is to check the information requested from Artful and 45002. This way you will find out if the S21 is valid. Do you understand this?Please do not quote spam as this enables it to 'live on' once the spam post is removed.

Hence my comment. Two recent experiences of mine were totally unexpected. Not least that both people concerned were fit and well beforehand. They were struck down unbelievably quickly.0
