APD refund on package holiday.

Sixth Anniversary Combo Breaker
Hi Guys

We had to cancel our holiday due to injury a week before flying. The insurance has paid us but not for the Airline Passenger Duty (tax) as they say it's down to the holiday company to pay us.

However Thomson are having none of it saying that as it's part of a package it's not repayable.

Anyone else had this problem?

    I think lots of people have found operators trying to keep what isn't their's but you should go back to your insurer and say you want a full refund, produce evidence that Thomsons won't pay and let your insurer chase them.

    I have contacted insurance but no reply as yet. I found an article on Thomsons own website regarding refunds for APD when they changed it for children and it says packages are included. So that is going on an email this afternoon. Thanks for your reply.

    They can't keep the child APD when the government reduces it, but that's a different scenario. I can't say I've ever heard of a TO refunding APD on a package when the customer has requested to cancel.

    10.1 TICKETS NON-REFUNDABLE
    Except as provided for in Article 10.2 below, all Tickets issued for flights operated by us are non-refundable. There are no refunds if any ticket holder misses or cancels their flight. Any governmental, per passenger taxes and charges for unused flights, which may have been collected in respect of such flight are refundable upon request (subject to a £25 administration fee per booking).
  • Section 10.1 may apply.

    That's the airline conditions of carriage for flight only bookings. Do the TOs booking terms and conditions say the same? I can't say I've ever looked as I've not booked anything with Thomson for several years.
  • I'll check out their terms for packages. I've not been with Thomson for years either but it was a special holiday and we were just fitting in with everyone else. I just don't see why we should lose £284 because they can't agree on who should pay.
