Hi all ,

After some advice again please. We are currently renting and our lease is due to end in two months. We came to an agreement to renew for another year. So last week the estate agents called to say they were sending out the contract.since the call I was offered a job transfer and have accepted the job. So we emailed the estate agents to notify them we would not be renewing the lease which is fine. They have responded by saying we still need to pay the admin fee for the contract. Can this be enforced even if we are not signing the contracts and renewing the lease.

I'm guessing there isn't much I can do and pay up.

    Well we didn't agree to pay anything. This the admin fee for a new tenancy agreement.

    Do not pay anything and wait and see what the Letting agents do.
    You can just wait till the end of the tenancy and move out OR give notice in writing,
    Take lots of dated photos and clean property from top to bottom.
    Dispute any deductions they try to make via DPS

    If so you certainly don't have to pay anything.

    We have already given notice we are leaving. The issue is we were going to stay, so the estate agents got a contract sent out to us to sign but while waiting for that to happen we have changed our mind. They are now saying we still need to pay the Admin fee for the renewal contract. Nothing has been signed and we have made them aware we are not continuing the lease now.

    You should not pay the admin fee.

    The landlord/agent may then make a claim for a deduction from your deposit (assuming you paid one) to cover the admin fee.

    You should refuse to accept the deduction, and request the full deposit (assuming there are no other debts eg rent or damage).

    If you and the LL/agent cannot agree, you should raise a dispute with the deposit scheme.

    You are likely to win, though of course this is not guaranteed.

    There is no need for you to discuss the fee matter with the agent any further (unless you need a reference..). You can wait until you've left & see what they do over the deposit.
