UKCPS fine but blue badge holder

Hi folks we received a screen ticket off these idiots. Parked in a disabled bay and forgot to put badge in window. Ignored them and they have sent invoice for £100.

I called the restaurant and asked them to call through to have it cancelled. Security said ring main number as it's been too long (only got letter today). Called main number (didn't state any details of who was driving etc) just told them registered keeper of car is blue badge holder.

They have said appeal with copy of blue badge in writing.

My concern is as they are not a council organisation mearly a company invoicing for money without knowing who driver is we begrudge giving them a copy of the blue bade.

Shall I just write in stating we will not be paying as a) they don't know who driver is and therefore invoice is void. B) State in writing registered keep is a blue badge holder.

Then basically leave it at that, if they then try to go to court basically were covered and can produce badge?

    I don't think a court would be overly impressed with that when you had the opportunity to produce it (as requested by the PPC) prior to the court having to be involved. If you're deemed by the court to have been 'unreasonable' you could be exposed to serious costs that are not normally awarded by the small claims court.

    You need to understand how this all works, so start by reading the NEWBIES FAQ sticky, post #1 (with #2 for acronyms) only at this stage. Come back if you need further help after reading and understanding the sticky.

    Blue Badges only apply on roads/public-regulated parking.

    They don't mean a thing in the wild-west world of private parking, where the cowboys only want your money.

    in this case they were not idiots , they were doing what the landowner had requested


    Ignored them and they have sent invoice for £100.

    should have done this in person on the day it happened , not 29-56 days later

    if the ticket (NTK) was delivered between day 29-56 and was written correctly then it was not void

    Just use the template appeal for IPC firms (the one in the NEWBIES PLEASE READ THESE FAQS FIRST' sticky thread) and attach a copy of both sides of your Blue Badge, along with an extra paragraph added to the standard letter, saying:

    I enclose the Blue Badge which is mine. I am the registered keeper of this car and was an occupant of the vehicle on the day, but the driver will not be named. UKCPS will have to demonstrate full compliance with Schedule 4 of the POFA 2012, should you pursue the matter against myself. The car was entitled to be parked there due to my disability, since as a passenger of a vehicle, I meet the definition of disability and have a right to use an appliable 'reasonable adjustment' (such as a disabled parking bay).

    The Blue Badge scheme applies only on-street on public highways and is not a reason to allow a private parking firm to unlawfully harass a disabled person for your own financial gain. I refer you to the outcome in Excel v Greenwood, Case Number 3QT60496 (4/10/2013) which was about a slipped Blue Badge, where the Judge found in favour of the defendant and held that Excel should have made a reasonable adjustment under the Equality Act, once they knew about the person's disability.

    I will not respond to debt collector letters and will assume the 'charge' to be cancelled if UKCPS do not serve a compliant letter before claim within 14 days. Take note I will also be escalating my complaint to the landowner and can advise you that the restaurant do not support the pursuit of this charge against a genuine customer with a lawful right to use a vehicle parked in that bay and the general feeling locally is that UKCPS are driving people away from local retailers and businesses. Your response will either confirm or deny that assertion and I have contacted the local press who are waiting to see how your company responds.
